Terms of Service

1. Acceptance of Terms

By accessing or using fdeinstinct.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Site.

2. Description of the Service

FDE Instinct is a career platform for Forward Deployed Engineers (FDEs) and aspiring FDEs. The Site provides skill assessments, educational content, interview preparation materials, salary benchmarking data, deployment case studies, and related career resources. Specific features and pricing may change over time; the current offering is always reflected on the Site.

3. Eligibility and Accounts

Eligibility

You must be at least 16 years old to use the Site. By using the Site you represent that you meet this requirement.

Google Sign-In

Account creation uses Google Sign-In. We do not store passwords. You are responsible for maintaining the security of your Google account and for all activity that occurs under your sign-in. If you believe your account has been compromised, contact us immediately at support@fdeinstinct.com.

One Account Per Person

You may maintain only one active account. We may suspend or merge duplicate accounts.

4. Free and Paid Features

Some features of the Site are available free of charge. Other features require a paid purchase. Access to paid features is determined by server-side entitlement checks — not by any client-side code — and may be granted, modified, or revoked in accordance with these Terms. Attempting to bypass entitlement checks is a violation of these Terms.

5. FDE Career Kit — Founding Lifetime

The "FDE Career Kit" is a one-time purchase that grants lifetime access to the paid features included in the kit at the time of purchase. "Lifetime" means the lifetime of the product and the Site — not your lifetime. If the Site or the product is discontinued, your access will end.

Founding Pricing

Founding pricing is available for a limited time and may be withdrawn at any notice. The founding price is a promotional discount and does not alter the scope of features or the meaning of "lifetime."

6. Prices, Taxes, and Payment Processing

All prices are displayed in United States Dollars (USD). Prices may change at any time; changes do not affect purchases already completed. You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction. Payment is processed by a third-party payment provider; by completing a purchase you agree to that provider's terms of service. We do not store your full payment card details.

7. Seven-Day Refund Policy

You may request a full refund within seven (7) calendar days of the date and time your payment was recorded ("paid_at" timestamp). After this window, no refund is available. To request a refund, email support@fdeinstinct.com with your account email and the date of purchase. Refunds are processed to the original payment method via our payment provider.

8. Chargebacks and Payment Disputes

Before initiating a chargeback or payment dispute with your bank or card issuer, please contact us at support@fdeinstinct.com. We will work with you to resolve the issue. Unjustified chargebacks may result in account suspension and collection of any fees or losses we incur as a result.

9. Acceptable Use

You May

• Use the Site for your own personal, non-commercial career development
• Access content and features you have legitimately purchased or that are made available free of charge
• Share your own assessment results or reports you have generated

You May Not

• Share, resell, or redistribute account access or purchased content
• Copy, scrape, or systematically download Site content
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Site
• Attempt to bypass or circumvent entitlement checks, paywalls, or security measures
• Use the Site for any unlawful purpose
• Harass, abuse, or threaten other users or our staff

10. Your Content and Shared Reports

You retain ownership of any content you submit to the Site, including assessment answers, interview responses, and notes. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and display that content solely for the purpose of operating and improving the Service.

When you generate a shareable report or link, anyone with the link may view the report. You are responsible for deciding whom to share the link with. We are not responsible for how third-party recipients use shared reports.

11. Our Content and Intellectual Property

All content on the Site — including text, graphics, logos, code, data compilations, assessment frameworks, and interview materials — is owned by FDE Instinct or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, create derivative works from, publicly display, or commercially exploit any Site content without our prior written consent.

12. Career, Job, and Salary Information

Salary figures, job listings, company profiles, and other career data on the Site are compiled from publicly available sources and may not be current, complete, or accurate. This information is provided for general informational purposes only and does not constitute professional career advice, an offer of employment, or a guarantee of any particular outcome. You should independently verify any information before making career or employment decisions based on it.

13. Third-Party Services and Links

The Site may contain links to third-party websites or integrate with third-party services (including but not limited to payment processors, AI providers, and analytics tools). We do not control and are not responsible for the availability, content, or practices of any third-party service. Your use of a third-party service is governed by that service's own terms and privacy policy.

14. Service Availability and Changes

We aim to keep the Site available and functional but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any feature or the entire Site at any time, with or without notice. If we discontinue a paid product, we will make reasonable efforts to provide advance notice and, at our discretion, offer a pro-rata refund for the unused portion of any prepaid period.

15. Suspension and Termination

We may suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Grounds for suspension or termination include, but are not limited to, violation of these Terms, fraudulent or abusive behaviour, and actions that harm the Site or other users. Upon termination, your right to use the Site ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 11, 16, 17, and 19.

16. Disclaimers

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FDE INSTINCT, ITS OWNER, OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US $100).

Nothing in these Terms limits any non-waivable consumer rights available under applicable law.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, provide notice on the Site. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Site.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Site will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, unless prohibited by applicable law. The arbitration will take place in Delaware, unless the parties agree otherwise. Each party bears its own costs.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for matters relating to intellectual property rights or unauthorized access to the Service.
